GARSVIELAS.LV, Registration No. 40203479378, address: Abelu iela 4, Salaspils, LV-2121, Latvia (hereinafter – the Online Store) provides the content available on the website and supplies goods/services in accordance with the Terms of Use set out below.

1. General Provisions

If a consumer purchases goods/services through the website, such mutual agreement shall be considered a Distance Contract and shall be governed by the laws of the Republic of Latvia regulating distance contracts, including but not limited to the Latvian Consumer Rights Protection Law and the Cabinet of Ministers Regulations “Regulations on Distance Contracts”, and other applicable legal acts.

2. Making Purchases

The prices and specifications of products sold in the Online Store are indicated next to each product.

To place an order, add the selected products to the shopping cart, complete all required fields, and choose the most suitable delivery method. The total order cost including delivery will then be displayed on the screen. Complete the payment to finalize the order.

3. Payment Terms

The transaction currency on the website is euro (EUR). Purchases can be paid for using the following payment methods provided by the payment platform makecommerce.lv, operated by Maksekeskus AS:

• Latvian internet banking payments: Swedbank, SEB, Citadele, Luminor

• Visa / Mastercard card payments

• Bank transfer

Note! When using internet banking, please confirm the payment and click the button “Return to merchant”.

Personal data required for payment processing is transferred to the licensed payment institution Maksekeskus AS.

The contract enters into force upon successful receipt of payment to the Online Store’s bank account. If for any reason the order cannot be fulfilled, the Buyer will be informed and the paid amount will be refunded as soon as possible, but no later than 14 days from the date of notification.

4. Delivery Terms

Goods are delivered only within Latvia. Purchased goods are delivered using OMNIVA, DPD, and Eksprespasts parcel lockers, as well as the company’s own delivery transport for express orders in Riga. Pickup from the Online Store’s order collection point is also available.

All duties and taxes payable in order to receive the shipment at the delivery destination shall be borne by the Buyer.

Delivery costs are displayed before order confirmation. Goods are delivered to the Buyer’s specified address within 3–5 business days. In exceptional cases, we reserve the right to deliver goods within up to 45 calendar days, informing the customer accordingly.

5. Right of Withdrawal

The Buyer has the right to withdraw from the purchase within 14 calendar days from the date of receipt of the goods. The right of withdrawal does not apply if the Buyer is a legal entity.

To exercise the 14-day right of withdrawal, goods may only be used for their intended purpose. The consumer is responsible for maintaining the quality and safety of the goods during the withdrawal period. If the goods have been used improperly, damaged, handled carelessly, instructions not followed, original packaging lost or significantly damaged, the Online Store has the right to reduce the refundable amount proportionally to the decrease in the value of the goods.

To exercise the right of withdrawal, a free-form request stating the product and order number must be sent to info@garsvielas.lv within 14 days of receiving the goods.

The Buyer bears the cost of returning the goods, except where the reason for return is that the goods do not correspond to the order (e.g. incorrect or damaged product).

The Buyer must return the goods to the Seller without delay, but no later than 14 days after submitting the withdrawal request. Upon receipt of the returned goods, the Online Store shall refund all payments received from the Buyer without delay, but no later than 14 days, based on the Distance Contract.

The Seller has the right to withhold the refund until the goods have been received from the Buyer or proof of return has been provided. If the Buyer has chosen a delivery method other than the cheapest option offered by the Online Store, the Online Store is not obliged to reimburse the additional delivery costs.

The Online Store shall not be liable for delays or failure to perform obligations caused by circumstances beyond its reasonable control.

The Online Store reserves the right to refuse the sale of goods and request their return if the price indicated in the Online Store is significantly lower than the market price due to an error.

The Buyer (consumer) may not exercise the right of withdrawal if any of the following conditions apply:

1. the goods are perishable or their expiration date expires soon (within the next three days);

2. the consumer has opened the packaging of goods which cannot be returned for health or hygiene reasons;

3. other cases specified in Cabinet of Ministers Regulation No. 255 of 20 May 2014 “Regulations on Distance Contracts”.

6. Consumer Rights Regarding Non-Conforming Goods

The Online Store is responsible for non-conformity of goods sold to the Buyer with the contract terms or defects that appear within 6 months from the date of delivery to the customer or existed at the time of delivery, unless such assumption contradicts the nature of the goods or the defect.

The Buyer must notify the Seller of non-conformity without delay, within 2 months of its discovery, by submitting a complaint via email to info@garsvielas.lv.

The Online Store is not responsible for defects that arise after delivery of the goods to the Buyer. If the goods have defects for which the Seller is responsible, the Buyer has the right to request free repair or replacement with new goods.

The Seller shall provide a written response to the consumer’s complaint within 15 days.

7. Processing of Buyer’s Personal Data

The Online Store processes only those personal data that the Buyer has provided when placing an order, such as name, surname, email address, etc.

Personal data is transferred to delivery service providers in order to ensure delivery of goods.

If you have clearly consented to receive our marketing communications, including newsletters, we may occasionally contact you with information about our services and latest offers. For this purpose, we may process your email address provided when subscribing to marketing communications. The Buyer may opt out of marketing communications at any time by notifying us via info@garsvielas.lv.

8. Dispute Resolution Procedure

In matters not covered by these Terms and Conditions, the Buyer and Seller shall comply with the applicable laws of the Republic of Latvia.

All disputes arising between the Seller and the Buyer shall be resolved through mutual negotiations or correspondence. If the dispute cannot be resolved amicably, it shall be settled in a court of the Republic of Latvia in accordance with Latvian law. Disputes between the Buyer (consumer) and the Seller may also be submitted to the Consumer Rights Protection Centre or a court of the Republic of Latvia.

The Buyer also has the right to refer disputes to European Union dispute resolution bodies.
